La vulneración del derecho a un proceso equitativo por la negativa inmotivada del Juez a oír personalmente a menores en proceso de divorcio

RESUMEN
La Sentencia del Tribunal Europeo de Derechos Humanos de 11 de octubre de 2016 (Iglesias Casarrubios y Cantalapiedra Iglesias c. España) declara la violación del derecho a un juicio justo de la madre demandante por parte del Estado español debido a la negativa injustificada por parte del Juez a oír directamente a sus hijas, que eran menores, en el proceso de divorcio iniciado por el padre en el que se le concede a este un derecho de visitas (que previamente se le había suspendido) sin que se corrija a través de los recursos ni la demanda de amparo.
ABSTRACT
The Judgment of the European Court of Human Rights of October 11th, 2016 (Iglesias Casarrubios and Cantalapiedra Iglesias v. Spain) declares the violation of the right to a fair trial of the claimant mother by the Spanish State due to the unjustified refusal on the part of the judge to hear directly her daughters, who were minors, in the divorce proceedings initiated by the father in which he is granted a visitation right (which had previously been suspended) without being corrected through of judicial reviews or the request for protection.
