The present work tries to analyse the existing problem in relation to the judicial competence that should be attributed in the cases that a Spanish person commits a crime of gender violence abroad. In those cases, and in application of the ones contemplated in the Law on Extraterritoriality of Criminal Law, the competent must be the National Court, all in application of the personal principle as an exception to the principle of territoriality, that governs as a preferential jurisdiction in our country.
